Stay of Execution Ruling Not Recognition of Owan Enoh as APC Candidate – Usani Campaign Organization

While Senator John Owan Enoh’s camp jubilated last Wednesday over the ruling of the Appeal Court’s which granted ‘Stay of Execution Order,’ to Sen John Owan Enoh and others, the Director-General of Usani Campaign Organization, Pastor Ekpeyong Cobham has explained that the ‘Stay of Execution Order’ issued by the court was misinterpreted and that it did not stamp legitimacy on Sen John Owan Enoh as party candidate.

Recall that the Federal High Court sitting in Calabar had recognized Godwin Etim John-led State Executive Committee as authentic Exco and ruled that only names of candidates submitted by the Etim John Exco be accepted by INEC to stand in the general elections.

John Ochala’s faction, in which Sen Owan Enoh is a strong member, had accordingly appealed the High Court judgment and prayed for stay of execution of the High Court Judgement. Last Wednesday, the court granted the request.

Cobham described as misleading and misinterpretation of fact media reports that the Appeal Court sitting in Calabar has pronounced John Owan Enoh candidate of APC in March 9, 2019 governorship contest.

In a chat with Journalists, weekend, the Director General said the insinuation of Owan’s candidature was totally untrue and a blatant falsehood by some section of the media.

“The same court which rejected Owan Enoh’s stay of execution plea last week, and upheld the judgment of the Federal High Court, Calabar, on February 11, 2019 which compelled INEC to delist Owan Enoh and others, cannot reverse itself,” he said.

According to him, the ‘status-quo,’in the ruling,  as at the time John Owan went for Appeal, was the judgment of the Federal High Court. He further explained that the said judgment has not been set aside by any court to suggest that Owan is now a candidate.

Describing the ‘Stay of Execution order’ as a “still-birth and dead on arrival,” Cobham noted that “the subsisting order of the court is the fact that Usani remains the APC candidate in Cross River State and by way of that judgment, at no point in time, did the stay of execution made Owan the candidate”

Cobham recalled that INEC has already implemented the judgment of the Federal High Court by recognizing Godwin Etim John as the authentic chairman APC, Cross River State.

…APC rejects Minister’s suspension

In similar vein, the faction of APC in the State headed by Godwin Etim John has rejected the suspension of the Minister of the Niger Delta Affairs, Pastor Usani Uguru Usani, and three others by the National Working Committee of the party on Saturday.

Mr Francis Ekpenyong, Secretary of the faction, who spoke to Journalists in Calabar over the matter said the National Working committee of APC oversteped its powers, explaining that the NWC does not have powers to suspend without the knowledge of the State Exco, which according to him, is the one led by Godwin Etim John.

Ekpenyong posited that any petition against Usani ought to have emanated from them to empower the NWC to act but that such never happened.

“How can they sit in Abuja and know how the minister is conducting anti-party activities in Cross River State? We ought to report to the national via a petition if actually Minister Usani was engaging in anti-party activities.

“We ought to have composed a panel to probe him if indeed he was engaging in anti-party activity, but such has never happened.

“It is John Owan Enoh, Hilliard Eta, Ndoma-Egba and others that are engaging in anti-party affairs, not Usani who effectively delivered his political ward and most parts of the state during the last presidential election whereas Ndoma-Egba and his friends did not. They were all rigged out.

“The national is the one working illegally by aligning with the faction of Owan Enoh and co led by John Ochala. This is contempt of court and we cannot accept it”, Ekpenyong said.
